Explanatory Note

Section 10 of the Dowry Prohibition Act, 1961 (Central Act 28 of 1961) empowers the State Government to make Rules for carrying out the purposes of the Act and the State Government had accordingly notified the Kerala Dowry Prohibition Rules, 1992 as per G.O.(P) No. 2/92/SWD dated, 30-1-1992 (S R O No. 100/92) for the purpose. But the Supreme Court in W.P (Civil) No. 499/1997 had directed the State Governments to adopt a common, model Dowry Prohibition Rules prepared and forwarded by the Union Government for the strict enforcement and implementation of the provision of the dowry Prohibition Act. This Notification, issued in super session of the previously existing Kerala dowry Prohibition Rules, 1992 is intended to achieve the above object.
